1. Definitions

  • "Platform" refers to SouqNass, including the website, mobile application, and any related services.
  • "User" refers to any individual or entity using SouqNass, including buyers and sellers.
  • "Vendor" refers to a user who registers to sell goods on SouqNass.
  • "Buyer" refers to a user who purchases goods from a vendor on SouqNass.
  • "We," "Us," or "Our" refers to SouqNass.

2. Acceptance of Terms

By creating an account, browsing, buying, or selling on SouqNass, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please do not use the Platform.

3. User Accounts

  1. Eligibility: You must be at least 18 years old to use the Platform. By registering, you confirm that the information you provide is accurate, complete, and current.
  2. Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account.
  3. Account Suspension or Termination: SouqNass reserves the right to suspend or terminate accounts for violations of these Terms, fraudulent activity, or misuse of the Platform.

4. Listing and Selling Products

  1. Permitted Items: Vendors may list second-hand goods that comply with our guidelines. Prohibited items include:
    • Illegal or counterfeit goods.
    • Hazardous materials.
    • Goods that violate intellectual property laws.
  2. Accuracy: Vendors must provide accurate descriptions, photos, and pricing for their items.
  3. Ownership: Vendors must have full ownership of and rights to sell listed items.
  4. Fees: SouqNass may charge a commission or listing fee. Fees will be disclosed before listing.

5. Purchasing Products

  1. Responsibility: Buyers are responsible for reviewing item descriptions and contacting vendors with any questions before purchase.
  2. Payment: Payments are handled directly between buyers and vendors. SouqNass does not process payments unless explicitly stated.
  3. No Guarantees: SouqNass does not guarantee the quality, safety, legality, or authenticity of listed items.

6. Delivery and Returns

  1. Delivery: Delivery arrangements are the responsibility of buyers and sellers. SouqNass does not provide delivery services unless explicitly stated.
  2. Returns and Refunds: Vendors must disclose their return and refund policies in their listings. Disputes are to be resolved directly between buyers and sellers.
  3. Disputes: SouqNass may mediate disputes but is not obligated to do so.

7. Prohibited Activities

Users must not:

  • Violate any applicable laws or regulations of the UAE.
  • Post false, misleading, or fraudulent content.
  • Use the Platform for illegal purposes.
  • Harass, abuse, or harm other users.
  • Engage in activities that could harm SouqNass’ reputation or functionality.

8. Intellectual Property

  1. Platform Content: All content on SouqNass, including logos, text, and graphics, is owned by SouqNass and protected by intellectual property laws of the UAE.
  2. User Content: Users grant SouqNass a non-exclusive, royalty-free license to use, modify, and display content uploaded to the Platform for promotional purposes.

9. Limitation of Liability

  1. SouqNass is a platform facilitating transactions between buyers and sellers. We are not responsible for:
    • The quality, legality, or safety of items listed.
    • Disputes between users.
    • Delivery or payment issues.
  2. To the fullest extent permitted by UAE law, SouqNass disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, or consequential damages.

10. Privacy Policy

SouqNass values user privacy. Please review our Privacy Policy to understand how we collect, use, and protect your information in compliance with UAE data protection regulations.

11. Modifications to Terms

SouqNass reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved exclusively in the courts of the UAE.

13. Dispute Resolution

  1. Informal Resolution: Users agree to attempt to resolve disputes informally by contacting SouqNass support.
  2. Formal Resolution: If informal resolution fails, disputes will be subject to mediation or arbitration as per UAE law.

  1. Vendors are responsible for ensuring compliance with UAE tax laws, including VAT registration and reporting if applicable.
  2. SouqNass will not be held liable for any tax-related issues arising from vendor activities.
